Freedom of Information Requests

 

 

 

The Monroe Conservation District is a local unit of government serving Monroe County and the greater general public of the state of Michigan. As such, we are committed to transparency and providing public access to records in accordance with the Michigan Freedom of Information Act (FOIA), Public Act 442 of 1976 (MCL 15.231 et seq.).

Submitting a Request

All FOIA requests must clearly describe the type(s) of records being requested, the exact timespan the requested records pertain to, and what format(s) compiled records need to be provided in so we can process your request as efficiently as possible.

All FOIA requests must be made in writting and may be delivered by:

Response Time

The District will respond to FOIA requests within five (5) business days of receipt. Under certain circumstances, the District may issue a 10-business-day extension as permitted by law.

 

Fees and Costs

The District may charge fees associated with processing FOIA requests, as allowed under Michigan law. These fees may include:

      • Labor costs to search for, locate, review, and compile records

      • Labor costs to separate exempt from non-exempt information (redaction)

      • Copying and duplication costs

      • Mailing or delivery costs

      • Costs associated with electronic media (if applicable)

Labor costs are calculated using the hourly rate of the lowest-paid employee capable of performing the work, plus a fringe benefit percentage as permitted by law.

If the estimated cost of fulfilling a request exceeds $50.00, the District may require a good-faith deposit (up to 50%) before beginning work on the request.

Additional Fee Information

      • Fees are based on the actual time and resources required to fulfill each request.

      • Requestors will be provided with a good-faith estimate of costs prior to processing when applicable.

      • All non-exempt records will be provided. If any information is withheld, the District will cite the applicable legal exemption.
